Persons under the age of 18 (“Minors”) must obtain their parents’ or legal guardians’ consent prior to participation.  By enrolling in our membership, you agree (or, if you are a Minor, your parent or legal guardian agrees) to be bound by these terms and conditions. To enroll in our membership program you must Accept these terms and conditions. Members must keep their personal information up-to-date.  Luxe Skin Care membership program is void where prohibited by law.

TERM

The minimum term of this agreement is 3 (three) months from the membership start date. Each period beginning on the membership start date is an “Agreement Month”. The membership may not be terminated during the minimum term period, other than as specified in Termination section. After the minimum term, unless you notify us prior to the beginning of your membership billing cycle, that you do not wish for the agreement to be renewed, the agreement will be automatically renewed for successive terms of 1 agreement month each. You will be responsible for paying the monthly fee in respect of the first 3 (three) agreement months.

TERMINATION

This agreement may be terminated in one of the following ways:

• You may terminate this agreement at your sole discretion by notifying us by email 30 days prior to start date (before your payment is due) of the next agreement month. Upon our receipt of your notice, your membership will be valid only until the Start Date of the next Agreement Month. If you decide to cancel after minimum term of three month and if we have not already charged one or all of these three months to your credit card, we may do so immediately upon receipt of your notice.

• In the event that we raise the prices of any of our memberships, we will notify you via email. After a change in price, you will have 30 days to terminate your membership agreement by notifying us.

• We may terminate this agreement at any time by notifying you. Your membership will be valid until the date that we provide you with such notice, and you will be responsible for paying the monthly fee in respect of the Agreement Month during which we terminated this agreement, but no future months. If we have not already charged this month to your credit card, we may do so immediately upon delivery of such notice.

FEES

You are responsible for the payment of all amounts for your chosen membership associated with this membership terms and conditions, whether or not you make use of the services offered, and hereby authorize us to charge any credit card that you provide to us from time to time for any amounts owing pursuant to this agreement. The membership fees do not reflect any other fees, which you must pay in addition to the relevant fee. Other than as set out in the “Termination” section above, we will charge your credit card the relevant fee on or about the first day of start of your membership Agreement Month. In the event that the pre-authorized payments you have agreed to pay by entering this contract do not go though two months in a row, we will suspend your membership and later terminate your membership without notice. After cancellation of your membership, you will lose your loyalty points/dollars, your service credits, any promotional credits/cards that you received as service discounts.

FREEZE/ROLLOVER & CHANGE

No more than once per 12 months, from the start of your membership, you may notify us in writing that you wish to freeze your membership for a period of one Agreement Month by notifying us prior to the start of such Agreement Month. Your membership will not be valid during such suspended Agreement Month, and the new service credit will not be issued to your account. As our membership program is designed to be utilized monthly, we do not allow membership credits to roll over.

SERVICES

Luxe Skin Care members are entitled to membership service every 30 days from the start of the membership at our location with an active membership status. All memberships are also to adhere to all other Luxe Skin Care clinic policies

SERVICE REWARD POINTS

All active memberships will collect reward points, every time you pre-book (book your next appointment before you leave). These loyalty points can be redeemed anytime 24 hours after they’re earned. If you’re account payment fails, those points will not apply, as the membership cancels.

PRODUCT REWARD POINTS

All active memberships will collect reward points, every time you purchase retail . These loyalty points can be redeemed anytime 24 hours after they’re earned. If you’re account payment fails, those points will not apply, as the membership cancels.

MEMBERSHIP PURCHASE

Purchase of memberships does not accrue reward points.

ASSIGNMENT

Your membership is personal to you and non-transferable, and you may not assign your rights to any other individual. We may assign our rights under this agreement on notice to you.

DISCLAIMER AND RELEASE

You hereby acknowledge that the services provided by Luxe Skin Care, anyone and any business associated with Luxe Skin Care, carry the risk of adverse skin reaction and/or minor injury, and release us from any claim with respect to any such reaction or injury. You are solely responsible for advising us in advance of any disability, condition, injury, skin or other disease, laser treatment, medical treatment, or allergy which could result in an increased risk of injury or reaction, or may not be compatible with the services that we provide.

GOVERNING LAW

This agreement shall be governed by the laws of the State of Texas, and the courts of the City of Dallas in the Dallas County shall have exclusive jurisdiction over any disputes relating to this agreement.

Luxe Skin Care (“we,” “us,” or the “Company”). Any notices relating to this agreement must be in writing and may be sent by mail or e-mail to the Company or the member (“you”), as applicable, at the contact information set out in this agreement.
